Welcome to Index™ (“we,” “us,” or “our”), a benchmarking and performance analytics platform for self-storage operators. By accessing or using our website, tools, or services (“Services”), you agree to the following Terms and Conditions. If you do not agree, please do not use the Services.

 

1. Use of the Services

You may use Index™ only for lawful business purposes and in accordance with these Terms. You agree not to:

• Misuse or interfere with the platform’s functionality

• Attempt to reverse-engineer, copy, or resell any part of Index™

• Use data provided by Index™ in any misleading, competitive, or unauthorized way

• Upload false, inaccurate, or misleading information

We reserve the right to suspend or terminate access to the Services if we believe you are in violation of these Terms.

 

2. Account Registration

To access certain features, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials

• All activity that occurs under your account

• Notifying us immediately of any unauthorized access or security concerns

 

3. Data and Benchmarking

When you use Index™, you may upload facility-level performance data or connect third-party data sources. By doing so, you:

• Warrant that you have the rights to use and share the data

• Grant us a license to process, analyze, and use the data for benchmarking purposes

• Acknowledge that we may use anonymized and aggregated data across the platform to power industry insights

We do not share or sell your personal or identifiable business data with third parties.

 

4. Intellectual Property

All content, analytics models, designs, trademarks, and code within Index™ are owned by us or our licensors. You may not copy, reproduce, distribute, or create derivative works from our platform without prior written consent.

 

5. Payment & Subscription Terms

If you are using paid services, you agree to:

• Pay all applicable fees according to your subscription or agreement

• Allow us to charge your selected payment method

• Contact us promptly regarding any billing issues

Late payments may result in suspension or termination of service.

 

6. Disclaimers

Index™ is provided “as is” and “as available.” We make no guarantees about:

• The accuracy, completeness, or timeliness of benchmarking data

• Uninterrupted or error-free service

• Specific outcomes or improvements in your business performance

You use the platform at your own risk.

 

7. Limitation of Liability

To the fullest extent allowed by law, Index™ shall not be liable for any indirect, incidental, special, or consequential damages—including lost profits, lost data, or business interruption—even if we were advised of the possibility.

Our total liability for any claim under these Terms will not exceed the amount you paid us in the preceding 12 months.

 

8. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the platform. You may cancel your subscription at any time according to your plan’s terms.

 

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" and may notify you via email or within the platform. Your continued use of Index™ after any updates constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws principles. Any disputes will be handled in the courts of Marion County Indiana.
